Purchasing Property in Malta and Gozo

Whether you are a first time buyer, in need to upgrade to a bigger home or looking for your first holiday home in Malta or Gozo buying a property in not a walk in the park.  With our expertise and experience we let our clients focus on the exciting bits while we do the ground work. 

To get you started below we have explained how the buying procedure unfolds after you decide to take the step forward.
 

:: The Preliminary Agreement
Once both the purchaser and the seller agree on the sale price a notary is appointed to represent the buyers.  The notary then drafts the Preliminary Agreement ( or Promise of Sale) which will point out the various terms and conditions the sale is subject to.  One of the main conditions is that the property being purchased has clean title.  Other conditions can include proper building permits, bank finance and if the purchasers are non-Maltese nationals the agreement will also be subject to them obtaining the AIP permit (more on this below).

A deposit is normally paid on the Promise of Sale, the amount can vary between 10% and 20% depending on what’s agreed between both parties. 

:: The Acquisition of Immovable Property (AIP) permit
This permit is required by most foreigners when purchasing property in Malta and Gozo.  The main condition of this permit is that the value of the property being purchased is over Lm39,730/€92,546 if an apartment and Lm66,198/€154,200 if a house.  Another condition that’s imposed is that the purchasers’ do not own another property in Gozo unless it’s in a specially designated area.  It is also important that the purchasers do not have a criminal record.  In certain cases an AIP permit is not needed, this instances are;

- If the applicant is an EU citizen and has resided in Malta and Gozo for more than five years.
- If the applicant is an EU citizen and is purchasing the property as his main residence.

:: Completion
Once the notary completes the title searches and all conditions of the Preliminary Agreement are satisfied the final contract can be drawn up by the notary and signed by all parties concerned and the balance is paid.

The duration between the Preliminary Agreement and the final contract is usually three months but this depends on a number of factors.  If the property being purchased is off-plan the final contract cannot be completed until the property is built and completed according to the specifications agreed.
